Power of Attorney for Foreign Property Buyers in Turkey

A power of attorney can allow a foreign buyer to complete legal and land-registry steps without repeated travel to Türkiye. It should, however, be drafted for the actual assignment. A document that is too narrow may fail at a critical stage, while an unnecessarily broad authority may expose the principal to avoidable risk.

The required form depends on where the power is signed, the nationality and language of the principal, and the acts the representative will perform. The final text should be checked before the appointment abroad.

Define the scope before drafting

Decide whether the representative will only obtain records and conduct due diligence or will also sign a contract, transfer funds, purchase, mortgage, register, insure or manage the property. These are different authorities.

Citizenship, residence, tax, banking and utility procedures should not be added automatically. Include only what is necessary and understood.

Signing at a Turkish consulate

Turkish consulates provide notarial services according to their procedures. Appointment, identity, photograph, property and representative information may be required depending on the transaction. The draft should be supplied in the requested format when special wording is needed.

Consular execution can simplify later use in Türkiye, but the receiving land registry or authority should confirm the required wording.

Signing before a foreign notary

A power signed abroad may require apostille or other legalisation and certified Turkish translation. Formal requirements vary by country and document. A simple private signature or online scan may be insufficient for land-registry acts.

Send the proposed draft to Turkish counsel before signing; correcting a defective power later can require a new appointment and additional cost.

Payment and banking authority

Authority to purchase property is not automatically authority to control a bank account or receive the sale price. Payment powers should be expressly considered and limited. The buyer should retain direct access to transaction statements and receipts.

Where possible, major payments should follow a verified written plan and be made directly between identified accounts. Do not disclose online banking passwords or one-time codes to a representative.

Revocation and completion

Keep the original and a certified copy of the signed power. Record where it has been used. When the assignment ends, consider whether formal revocation and notice are appropriate. Revocation must reach relevant persons and authorities to reduce continuing reliance.

A power of attorney creates authority; it does not by itself prove that the underlying property is safe. Independent title and contract checks remain necessary.

Practical document checklist

  • Principal’s passport and identity details
  • Representative’s complete identity information
  • Exact property or transaction description where available
  • List of permitted acts and express limitations
  • Apostille/legalisation and translation requirements
  • Payment and receipt authority considered separately
  • Revocation and document-return plan
