Short-term rental income is attractive to many Alanya property owners, but ownership alone does not create an unrestricted right to advertise a home for tourist stays. Türkiye regulates tourism-purpose rental through Law No. 7464 and its implementing rules. The legal position depends on the duration and character of the rental, the building, the applicant and the documents submitted.
The official permit framework has applied since 1 January 2024. Administrative fines and other consequences may apply where tourism-purpose rental is conducted without the required permit. Because amounts and procedures may change, owners should verify current rules before advertising or accepting reservations.
The owner should determine whether the intended activity falls within the statutory tourism-purpose rental regime and whether a Ministry permit is required. The analysis should be completed before listing the property on a platform or giving possession to short-stay guests.
Applications and official guidance are available through the Ministry of Culture and Tourism and the relevant e-Government service. Platform practices do not replace legal authorisation.
For many ordinary residential buildings, the required consent of other independent-section owners is a central issue. The exact consent requirement and available exceptions must be checked against the building type, number of independent sections and current rules. A management plan or earlier decision does not automatically satisfy every statutory condition.
High-quality residence certificates or other special building classifications should be verified through official documents. Marketing descriptions such as “residence” or “hotel concept” are not sufficient.
The title record, independent-section type, address and applicant’s ownership must be consistent. Fire safety, equipment, capacity, identification and record-keeping obligations may also apply. The permitted capacity should not be exceeded.
Building management, municipal rules and private-law restrictions may create additional disputes even where an administrative permit is obtained. Noise, common-area use and security procedures should be addressed.
A foreign owner may appoint a representative for appropriate procedural steps, but the power of attorney must cover the required acts. Residence status and ownership should not be confused with tourism-rental permission.
Rental income can create Turkish tax and reporting obligations. Commission, platform fees, management payments and expenses should be documented. Obtain current tax advice for the owner’s residence and treaty position.
Do not purchase merely because an advertisement states “Airbnb suitable.” Request the title record, management plan, owners’ decisions, existing permit information and building documents before committing. The ability of another apartment to rent short term does not prove that the proposed unit will receive a permit.
Make rental-permit feasibility a written due-diligence issue and avoid relying on future consent that the seller cannot guarantee.
