Northern Cyprus Inheritance and Probate Lawyer: Wills, Estate Administration and Cap. 195 Succession Law
Foreign nationals who own immovable property (villas, apartments, or registered Contracts of Sale) or bank accounts in Kyrenia (Girne), Iskele, Famagusta (Gazimağusa), or Nicosia (Lefkoşa) are subject to the inheritance and probate rules of the Turkish Republic of Northern Cyprus (TRNC) under the Wills and Succession Law (Cap. 195 / Vasiyetnameler ve Veraset Yasası Fasıl 195) and the Administration of Estates Law (Cap. 189). Because immovable property in Northern Cyprus is governed strictly by the law of the place where the property is situated (lex rei sitae), a foreign will or foreign grant of probate does not automatically transfer a Northern Cyprus title deed (Koçan) without formal proceedings before the District Court Probate Registry (Tereke Mukayyitliği).
1. Drafting and Registering a Formal Will (Vasiyetname) in Northern Cyprus
Under Cap. 195, a will executed in Northern Cyprus must satisfy strict formal validity rules to be admitted to probate:
- Written Execution Before Independent Witnesses: The testator must sign every page of the will in the simultaneous presence of at least two competent adult witnesses who are not beneficiaries (or spouses of beneficiaries) under the will.
- Official Deposit at the District Court Probate Registry: Once executed, our lawyers deposit the original sealed will directly with the Probate Registrar (Tereke Mukayyidi) of the relevant District Court (Kyrenia, Nicosia, Famagusta, or Iskele), ensuring the instrument cannot be lost, altered, or suppressed.
- Testamentary Freedom for Foreign Domiciliaries: Under Cap. 195, testators domiciled outside Northern Cyprus (particularly citizens of Commonwealth or foreign jurisdictions) can enjoy broad testamentary freedom over their estate when properly structured in accordance with statutory conflict-of-law rules.
2. Probate and Estate Administration (Tereke İdaresi) After Death
Testate Estates (Where a Local Will Exists)
When the deceased leaves a valid will registered at the District Court, the named executor (typically a partner from our Northern Cyprus Office) files a petition for a Grant of Probate. Following inventory declarations, tax clearance certificates (Vergi Dairesi Stopaj / Veraset İlişik Kesme), and accounting to the Probate Registrar, the executor transfers the immovable property (Koçan) or registered Contract of Sale directly to the named beneficiaries.
Intestate Estates (Where No Local Will Exists — Letters of Administration)
If a foreign owner passes away without a local Northern Cyprus will, the estate must go through full intestate administration (İrade-i Seniyye / Tereke İdaresi). Legal heirs must provide legalized birth, marriage, and death certificates along with a formal certificate of heirs, appoint an administrator before the District Court, furnish statutory security bonds, publish creditor notices in the Official Gazette (Resmi Gazete), settle liabilities, and obtain a court order distributing the estate.
Frequently Asked Questions — Northern Cyprus Inheritance Law
Can heirs inherit a property if the deceased only had a registered Contract of Sale and had not yet received the final Koçan?
Yes. Contractual rights under a stamped and registered Contract of Sale form part of the deceased’s estate (Tereke). The court-appointed executor or administrator steps into the shoes of the deceased buyer to assign the contract or complete title transfer to the heirs.
